OTIS Advocaten have successfully adapted to the ‘new normality’, and this has led to many positive developments, always aiming to help our clients, especially after the situation generated by the COVID-19. That is why, in today’s post, we are going to mention an issue that has been born with the goal to improve the relationship between lawyers and clients.

The Spanish legal sector has long been claiming the need for a Legal Defence Law. In other words, a law that regulates one of the fundamental pillars of our Justice; and to develop this fundamental right, recognized in article 24 of the Spanish Constitution.

Well, this week took place the first meeting of the Commission that will shape this legislative project. In the words of its members, the Commission pretends to develop a law that will provide a greater protection to our citizens and their Defense right.

One of the main objectives of this Commission is to unite in a single legal text the right of Defense, since it is now scattered within numerous regulations. This new law will cover all the facets in which the right of Defense is manifested, both in the lawyer-client treatment and in the judicial processes. Indeed, courts and tribunals will have to adapt to new technologies, since -to guarantee our health- the possibility of holding trials without the need for all parties to be physically present is even being studied. After the ‘new normality’ that the Coronavirus pandemic has generated, the judicial processes and the legal and professional relationships are going to change; the day to day practice of law in Spain will never be the same.

Therefore, a law like this one is necessary in order to protect the interests and rights of citizens within the legal world.
