Shorter work week and digital registration on the way in Spain

The Spanish government, together with labor unions, has reached an agreement on a bill that shortens the maximum workweek, mandates digital time tracking and strengthens the right to digital disconnection (rest). Employer organizations were not part of this agreement.

What is the status of the law?

The law is not yet final. After a second approval by the Council of Ministers (expected in late February), the proposal will go to parliament. Changes can be made there. Final approval is not expected before May or June 2025, and implementation may take even longer.

What will change?

1- Shorter work week – The maximum work week will be 37.5 hours. Unions have until the end of 2025 to adjust their collective bargaining agreements accordingly.

  1. Digital timekeeping – Employers must implement a digital system that can be accessed by employees, unions and labor inspection. Violations or failure to comply can be punished.
  2. Right to digital rest – Employees may not only refuse to respond outside of working hours, but also demand not to receive messages.

What does this mean for companies?

The impact varies by industry. Companies with shorter work weeks notice little change, while others have to rethink how they work. Good preparation prevents last-minute problems.
